End-User License Agreement

This Agreement (hereinafter referred to as the “Agreement”) constitutes a legal agreement entered into between LLC "ITMarket" (hereinafter referred to as the “Licensor” or “Service Operator”), the holder of exclusive rights to the Software Product «DOMONAP» (hereinafter referred to as the “SP”), and the End User. Collectively, they are referred to as the “Parties,” and individually as a “Party.” If the End User does not agree to accept the terms of this Agreement, they are prohibited from using the SP. By performing actions to install the Mobile Application, the End User confirms their full and unconditional acceptance of all terms of this Agreement and agrees to comply with them.

  • Service Operator – LLC "ITMarket";
  • Software Product (SP) – the software suite «DOMONAP», a result of intellectual activity consisting of software (computer programs), databases, and other information accessible via the Internet through the domain name domonap.ru, using the Mobile Application or a web browser;
  • Mobile Application – a program for mobile devices, available in multiple versions (each possessing similar properties and functions) and free to download and install on mobile devices via specialized services such as «Google Play», «Apple Store», or similar platforms. Versions of the Mobile Application may differ due to variations in the operating systems of the mobile devices for which they are intended.
  • Intercom System – an electronic access control system installed at the entrance of the End User’s residential building or control block. The Intercom System may be equipped with and/or supplemented by any additional devices and systems, such as extra surveillance cameras, gate control systems for entry onto the premises, yard video surveillance, etc.
  • Apartment – a residential unit located in a multi-unit building or house equipped with an Intercom System, owned by the End User under property rights or another lawful basis.
  • Address – the physical address where the Apartment is located. The format is: Postal Code, Country, Region, City, Street, Building Number, Structure/Building Wing, Entrance, Apartment Number. The End User sends a Connection Request to the Service Operator to gain access to the SP features at this specified Address and obtain the status of a Resident for the Address indicated in the Connection Request.
  • End User – an individual or legal entity using the SP in the manner defined by this Agreement, without the right to transfer usage rights to third parties;
  • Connection Request – a feedback form used by the End User to request connection of their Apartment to the SP;
  • Resident – an End User who has submitted a Connection Request, confirmed their Address, and acts as an End User who manages access to their Address, receives guests, and uses functionalities available exclusively to End Users who have submitted a Connection Request and confirmed their Address;
  • Guest – an End User who may or may not have submitted a Connection Request and confirmed their Address. A Guest visits the Addresses of other End Users and uses the SP functionality to call Residents requesting access to the Address or uses a pre-created digital invitation key (Key-Invitation) issued by a Resident;
  • Digital Key – a functional feature of the SP enabling actual access control management for an Address. Using the Digital Key feature, the End User unlocks locking mechanisms installed on entrance doors, gates, barriers, or other access control systems. The End User receives the Digital Key after submitting a Connection Request to the Service Operator and confirming their Address. The User bears full personal responsibility when using the Digital Key to grant access to the entrance.
  • Key-Invitation – a type of Digital Key that a Resident sends to a Guest via the SP's functionality, granting temporary access control privileges to the Resident’s Address. The Resident bears full personal responsibility for any Key-Invitations issued, while the Guest bears full personal responsibility for their actions within the premises accessed using the Key-Invitation.
  • Key Generation – a functional feature of the SP that enables the creation of a Digital Key and confirmation of an Address without submitting a Connection Request. It allows a Resident to confirm the Address of their neighbor within the same entrance. The Resident, using the “Generate Key” function, assumes full responsibility for granting access to a third party and for the accuracy of their data and Address (Apartment).
  • Chat – a functional feature of the SP enabling Residents to communicate via electronic messaging and send images (photos). Available as group chats connecting all Residents with confirmed Addresses within one entrance, and personal chats between Residents of one Apartment and Residents of another Apartment within the same entrance and confirmed Address.

WAYS OF USING THE SP

Unless otherwise specified in this Agreement, the End User may use the SP as follows:

  • The availability of features and services within the application is determined by the Service Operator providing service at the location of the End User’s Apartment.
  • Submitting a Connection Request in the Mobile Application to connect the Apartment—owned by the End User under property rights or another lawful basis—to the SP and obtaining Resident status.
  • Viewing real-time video during video calls initiated between End Users.
  • Using real-time audio calls during audio calls initiated between End Users.
  • Activating (initiating) the opening of magnetic locks, barriers, gates, doors, and other objects connected to the SP via Digital Keys and Key-Invitations.
  • Receiving incoming calls from Guests in the Mobile Application and communicating with calling End Users.
  • Communicating with other Residents via online group and individual Chats within the same entrance.
  • Using the SP to visit other addresses that are not the Apartment Address specified by the End User in their Connection Request, in the role of a Guest.
  • Using the SP to call other End Users (Residents) via the video intercom at addresses that are not the Apartment Address specified in the End User’s Connection Request, where they hold Resident status.
  • Sending Key-Invitations—full access rights to selected Addresses—to other users acting as Guests who do not reside at the Address specified by the End User in their Connection Request.
  • Using any other available functionality included in the Mobile Application solely for the Apartment specified by the End User in their Connection Request, as per Section 2.1.1 of this Agreement.
  • The End User is not permitted to use the Software Product or perform actions not explicitly provided for by this Agreement and/or the Mobile Application.

ADDITIONAL TERMS

  • The End User agrees that the Licensor and Service Operator have the right to involve third parties for processing connection requests, which include the End User’s address and mobile phone number.
  • The End User bears personal responsibility for access granted to their Addresses via Digital Keys, Key-Invitations, and the Key Generation functionality.
  • The End User agrees to comply with the legislation of the Russian Federation and refrain from unlawful actions directly or indirectly related to the use of the SP.
  • End Users are prohibited from using offensive language or insulting other End Users when using Chats, Video, or Audio calls, or from distributing texts or materials that could offend other End Users or violate the Criminal Code of the Russian Federation (CC RF).
  • The Licensor and Service Operator reserve the right to deny service to an End User and block their account if this Agreement, the CC RF, or the Civil Code of the Russian Federation (Civil Code) is violated.
  • In case of detection of unlawful activities, upon request from regulatory or law enforcement agencies, the End User’s personal data and usage data will be transferred to the relevant authorities in accordance with the laws of the Russian Federation.
  • By agreeing to this Agreement, the End User acknowledges and confirms that they bear individual responsibility for their actions involving the SP, and that the SP’s functionality equates to real-world access control actions. Issuing a Digital Key, Key-Invitation, or generating a key is equivalent to physically granting someone access to the associated Address and carries corresponding consequences.
  • The Licensor and Service Operator are not responsible for the End Users’ use of the SP’s functionality, accesses granted by them within the SP, or actions performed.
  • The End User hereby confirms and guarantees to the Licensor that they are not a consumer as defined by the Federal Law No. 2300-1 dated February 7, 1992, “On Consumer Rights Protection.”
  • The Licensor has the right, independently or with the involvement of third parties, to monitor the End User’s use of the SP by any lawful means to ensure compliance with the terms and restrictions of this Agreement.
  • The Licensor provides the SP to the End User “as is.” The Licensor does not guarantee that the SP is error-free and is not liable for any direct or indirect damages (losses) incurred by the End User or any third parties, including but not limited to: lost profits, property losses, loss of confidential information, resulting from the use of the SP, including due to possible errors or typos within the SP.
  • The Licensor does not guarantee that the SP will meet the End User’s requirements, nor does it guarantee the SP’s compatibility or proper functioning with other software or hardware from different manufacturers.
  • This Agreement shall be published within the Mobile Application. The terms of this Agreement may be unilaterally amended by the Licensor without judicial intervention by publishing a new version of the Agreement in the Mobile Application. The updated terms shall take effect on the day following the publication date of the new version.
  • The Licensor reserves the right to unilaterally terminate this Agreement at any time by notifying the End User, in the event of a violation of the Agreement’s terms by the End User.
  • This Agreement remains effective for the duration of the End User’s use of the SP/Mobile Application and applies to all subsequent updates and new versions of the SP.
